OVERVIEW

Welcome to Wallsio Art.

These Terms of Service (“Terms”) govern your access to and use of the Wallsio Art website, store, and related services (collectively, the “Services”).

Wallsio Art is a trading brand operated by Viromo Jakub Paśnik (VAT/NIP: PL5512645139), a sole proprietorship registered in Poland. The Services are powered by Shopify, which provides the e-commerce platform that enables the store to operate.

By visiting, interacting with, or using the Services, you agree to be bound by these Terms and by the policies referenced here, including the Privacy Policy, Shipping Policy, and Return & Refund Policy. If you do not agree to these Terms, you should not use or access the Services.

SECTION 1 – ACCESS AND ACCOUNT

By using the Services, you confirm that you are at least the age of majority in your place of residence, or that you have legal consent to allow any minor dependents to use the Services under your supervision.

To use certain features of the Services (including making a purchase), you may be asked to provide information such as your email address, billing details, payment details, and shipping address.

You agree that all information provided is accurate, current, and complete, and that you have the right to provide it. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to any other person.

SECTION 2 – PRODUCTS AND INFORMATION

Every effort is made to provide accurate descriptions and representations of products.

All wall art prints and framed prints are produced made-to-order specifically for each customer order. Because screens and devices vary, colors and appearance may differ slightly from what is displayed online.

Product descriptions, availability, and pricing may change from time to time. The right is reserved to discontinue products at any time and to limit quantities on a case-by-case basis.

SECTION 3 – ORDERS

When you place an order, you are making an offer to purchase.

The right is reserved to accept, decline, or cancel an order for any reason, including for suspected fraud, pricing errors, or inventory/production limitations. An order is considered accepted only when confirmation is provided and payment has been successfully processed.

Because products are made-to-order, cancellation or changes may not be possible once production begins. If an order cannot be accepted or must be changed or canceled, notification will be attempted using the contact details provided at checkout.

Returns and refunds are handled only in accordance with the Return & Refund Policy.

Orders are intended for personal or household use only, not for commercial resale.

SECTION 4 – PRICES AND BILLING

Prices, discounts, and promotions may change without notice.

The price charged is the price displayed at the time the order is placed and will appear in the order confirmation. Unless otherwise stated, prices do not include customs duties, import taxes, brokerage fees, or similar charges that may apply outside the European Union.

You agree to provide current and accurate purchase and payment information and to keep account details updated so transactions can be processed and you can be contacted if necessary.

SECTION 5 – SHIPPING AND DELIVERY

Shipping and delivery timelines are estimates only and are not guaranteed.

Delays may occur due to shipping carriers, customs processing, weather, or circumstances beyond control. Risk of loss may transfer to the customer once the order is handed over to the carrier, subject to applicable consumer protection laws.

SECTION 6 – INTELLECTUAL PROPERTY

All content included in the Services (including text, graphics, images, product designs, logos, and website layout) is owned by Wallsio Art and/or its licensors and is protected by intellectual property laws.

You may use the Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works, publicly display, or exploit any portion of the Services without prior written consent, except as permitted by law.

“Shopify” and related marks are trademarks of Shopify. All other trademarks are the property of their respective owners.

SECTION 7 – OPTIONAL TOOLS

The Services may provide access to third-party tools. These tools are provided “as is” and “as available,” without warranties. Use of such tools is at your own risk and discretion, and you should review any third-party terms applicable to them.

SECTION 8 – THIRD-PARTY LINKS

The Services may contain links to third-party websites. These websites are not controlled and are not responsible for their content, privacy practices, or policies. Access to third-party sites is at your own risk.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

The store is powered by Shopify, which provides the e-commerce platform. Purchases made through the store are made directly with Wallsio Art.

Shopify is not responsible for the sales transaction between the customer and Wallsio Art. To the extent permitted by law, Shopify and its affiliates are released from claims arising from purchases made through the store.

SECTION 10 – PRIVACY

Personal information collected through the Services is handled in accordance with the Privacy Policy. Because the Services are hosted by Shopify, Shopify may also collect and process certain information in order to provide and improve the platform.

SECTION 11 – FEEDBACK AND USER CONTENT

If you submit reviews, ideas, suggestions, or other content (“Feedback”), you grant a worldwide, royalty-free, sublicensable license to use that Feedback for operating, improving, and promoting the Services.

You represent that you have the rights to submit the Feedback and that it does not violate third-party rights or applicable laws.

SECTION 12 – ERRORS, INACCURACIES, AND OMISSIONS

Occasionally, information on the Services may contain typographical errors or inaccuracies related to product descriptions, pricing, promotions, shipping details, or availability.

The right is reserved to correct errors and update information at any time, including after an order is submitted. If an order is affected by a material error, the customer will be informed and appropriate options will be offered.

SECTION 13 – PROHIBITED USES

You may use the Services only for lawful purposes. You agree not to use the Services to:

  • Violate any applicable laws or regulations

  • Infringe intellectual property rights

  • Transmit malware or harmful code

  • Attempt unauthorized access, scraping, or interference with security features

  • Provide false or misleading information

  • Harass, abuse, or harm others

Access may be suspended or terminated for violations of these Terms.

SECTION 14 – TERMINATION

Access to the Services may be terminated at any time if these Terms are violated. Termination does not affect obligations incurred prior to termination.

Sections that by their nature should survive termination will continue to apply, including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, and Governing Law.

SECTION 15 – DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, the Services and products are provided “as is” and “as available,” without warranties of any kind, whether express or implied.

Nothing in these Terms limits consumer rights that cannot be excluded under applicable law.

SECTION 16 – LIMITATION OF LIABILITY

To the fullest extent permitted by law, Wallsio Art shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or lost data, arising from use of the Services or products.

Nothing in these Terms excludes or limits liability where such limitation is not permitted by law, including mandatory consumer protections.

SECTION 17 – INDEMNIFICATION

You agree to indemnify and hold harmless Wallsio Art and service providers (including Shopify) from claims arising out of your breach of these Terms, your violation of law, or infringement of third-party rights, to the extent permitted by law.

SECTION 18 – SEVERABILITY

If any provision of these Terms is found unlawful or unenforceable, the remaining provisions will remain in full force and effect.

SECTION 19 – WAIVER AND ENTIRE AGREEMENT

Failure to enforce any provision is not a waiver. These Terms and the referenced policies constitute the entire agreement between you and Wallsio Art regarding use of the Services.

SECTION 20 – ASSIGNMENT

You may not assign your rights or obligations under these Terms without prior written consent. These Terms may be assigned by Wallsio Art as part of business operations, to the extent permitted by law.

SECTION 21 – GOVERNING LAW

These Terms are governed by the laws of the Republic of Poland.

For consumers located in the European Union, mandatory consumer protection laws in the consumer’s country of residence will also apply to the extent they provide a higher level of protection.

SECTION 22 – HEADINGS

Headings are for convenience only and do not affect interpretation.

SECTION 23 – CHANGES TO TERMS

These Terms may be updated from time to time. The most current version will always be available on this page. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
